Terms of Service

1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you and Tellper Co. LLC ("Tellper," "we," "our," or "us") governing your access to and use of the Tellper application, including any updates, new features, and related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

You must be at least 16 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement. If you are using the Services on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

3.1 Account Creation

You must create an account to use certain features of our Services. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account. We will not share your identification information with third parties.

3.3 One Person, One Account

Each person may maintain only one active account. Accounts registered by "bots" or automated methods are not permitted.

4. Trial and Subscription Terms

4.1 Limited Trial

Upon registration, you will receive a limited trial of 10 requests. Once you have used all 10 requests, you will need to purchase a subscription to continue using the Services.

4.2 Subscription Charges

After your trial ends, you can purchase a subscription to continue using the Services. We will charge you from the date you convert to a paid account and on each periodic renewal until cancellation. You are responsible for all applicable taxes, and we'll charge tax when required.

4.3 Cancellation

You may cancel your subscription at any time. Some countries have mandatory local laws regarding cancellation rights, and nothing in these Terms overrides these laws.

5. Acceptable Use

a. Compliance With Laws

You may not use our Services for any illegal, harmful, or abusive activity.

b. Prohibited Activities

You may not:

  • Use our Services in a way that infringes, misappropriates, or violates anyone's rights
  • Modify, copy, lease, sell, or distribute any of our Services
  • Attempt to or assist anyone to reverse engineer, decompile, or discover the source code or underlying components of our Services
  • Automatically or programmatically extract data or output
  • Represent that output was human-generated when it was not
  • Interfere with or disrupt our Services

c. Content Limitations

You understand that:

  • Output may not always be accurate
  • You must evaluate output for accuracy and appropriateness
  • You must not use any output relating to a person for any purpose that could have a legal or material impact on that person

6. Intellectual Property Rights

6.1 Your Content

You retain ownership of content you provide to the Services, including your inputs and the outputs generated specifically for you by the Services.

6.2 Our Services

Tellper owns all rights, title, and interest in and to the Services, including all intellectual property rights. We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Services subject to these Terms.

6.3 Feedback

If you provide feedback, ideas, or suggestions about our Services ("Feedback"), we are free to use such Feedback without compensation or attribution to you.

7. Termination

7.1 Termination by You

You may stop using our Services at any time.

7.2 Termination by Us

We may suspend or terminate your access to the Services if:

  • You breach these Terms
  • We are required to do so by law
  • We decide to discontinue the Services

8. Disclaimer of Warranties

BY USING OUR SERVICES, YOU UNDERSTAND AND AGREE THAT ALL RESOURCES WE PROVIDE ARE "AS IS" AND "AS AVAILABLE". THIS MEANS THAT WE DO NOT REPRESENT OR WARRANT TO YOU THAT:

  1. THE USE OF OUR RESOURCES WILL MEET YOUR NEEDS OR REQUIREMENTS
  2. THE USE OF OUR RESOURCES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE FROM ERRORS
  3. THE INFORMATION OBTAINED BY USING OUR RESOURCES WILL BE ACCURATE OR RELIABLE
  4. ANY DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY RESOURCES WE PROVIDE WILL BE REPAIRED OR CORRECTED

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TELLPER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Tellper, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

11. Third-Party Services

11.1 Integration with Third Parties

Our Services integrate with third-party services such as DeepSeek and OpenAI. You acknowledge that:

  • Third-party AI services may experience downtime, maintenance windows, or service degradation
  • DeepSeek or OpenAI might modify their APIs with little notice
  • These services have their own content policies
  • These services typically impose usage limits
  • AI responses may sometimes be inaccurate, irrelevant, or inappropriate
  • All data transmitted to these services is encrypted

12. App-Specific Permissions

12.1 Accessibility Service

On Android devices, our app requires accessibility permissions to function properly. We do not use accessibility services to abuse the Android platform; we only require this permission so our application functions properly.

12.2 Overlay Permission

Our app requires overlay permission to display a floating microphone button. We only use this permission as necessary for the core functionality of our application.

13. Governing Law and Dispute Resolution

This application is controlled by Tellper Co. LLC. It can be accessed by most countries around the world. By accessing our website or using our app, you agree that the statutes and laws of our state, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of our Services.

14. Changes to Terms

We may modify these Terms at any time. If we do so, we will notify you through in-app notification. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the modified Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms constitute the entire agreement between you and Tellper regarding your use of the Services and supersede all prior agreements and understandings.

15.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

15.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent, but we may assign or transfer these Terms without restriction.
